Section #1: Info Required for ALL Types of Permit Applications

🟦 APPLICANT INFORMATION:

The applicant must either own the property or be authorized by the property owner to apply on their behalf.
The applicant must be registered in the Baldwin County CitizenServe Portal. Registration can be completed online or by submitting a Portal Registration form and requires the applicant's name, mailing address, phone number, email, government issued photo ID, and signature.

🟦 PROPERTY OWNER INFORMATION:

Provide the name(s) listed on the deed, along with the mailing address, phone number, and email.

🟦 CONTRACTOR INFORMATION:

The contractor must be registered in the Baldwin County CitizenServe Portal. Registration can be completed online or by submitting a Portal Registration form and requires the business name, license holder's name, mailing address, phone number, email, government issued photo ID, signature, contractor license(s), and State of Alabama business license. The name, ID, and signature on the registration must match the name on the contractor license(s) and business license. Only one portal account is allowed per business license.
Note: If the property owner will be doing the work themselves (not hiring a contractor), enter "Property Owner" in the contractor section and, if applicable, submit one of the following forms:
(1) State of Alabama Home Builders Licensure Law Exemption or
(2) State of Alabama Licensing Board for General Contractors Licensure Law Exemption.

🟦 PARCEL ID NUMBER and/or ADDRESS ASSIGNED BY BALDWIN COUNTY 911:

You can find the parcel ID number on the tax bill, at open.baldwincountyal.gov, by contacting the Revenue Commissioner, or by calling 251-937-0245.
Note: When submitting permit application online, add 05- to the parcel ID (e.g., 05-00-00-00-0-000-000.000).
If the property doesn't have an address, request one at www.baldwin911.org.

🟦 DETAILED SCOPE OF WORK:

Clearly describe all work to be performed, including materials and construction methods. Note: Any changes after approval will require a revision request.

🟦 JOB VALUATION:

State the total cost of labor and materials for the permitted work only. (e.g., Don't include electrical work in a building permit application). Note: A signed contract showing job valuation may be requested.

🟦 USE OF STRUCTURE and/or STORAGE AREA:

Describe the intended use of the structure. Include details on what will be stored inside, if applicable.

Section #2: Contractor Licenses and Requirements

All contractors must be registered in the Baldwin County CitizenServe Portal. Registration can be completed online or by submitting a Portal Registration form and requires the business name, license holder's name, mailing address, phone number, email, government issued photo ID, signature, contractor license(s), and State of Alabama business license. The name, ID, and signature on the registration must match the name on the contractor license(s) and business license. Only one portal account is allowed per business license.

During the application review process and before a permit is issued, Building Department Permit Technicians will verify that the contractor listed on the application has registered in the portal, has provided all required documents, and holds the proper license(s) for the scope of work and job valuation listed on the application.

🟦 ALL CONTRACTORS:

All contractors working in the Baldwin County building permit jurisdiction are required to hold an active State of Alabama business license that is issued through any county in the state. For information on how to obtain the required business license, visit the County's Probate Office website at https://baldwincountyal.gov/government/probate-office/licenses/business-license.

🟦 TRADE CONTRACTORS (ELECTRICAL, MECHANICAL/HVAC, PLUMBING, GAS, and FIRE PROTECTION SPRINKLERS):

Electrical contractors are required to hold an active Electrical Contractor license from the Alabama Electrical Contractors Board at https://aecb.alabama.gov/.
Mechanical/HVAC contractors are required to hold an active HVAC license from the Alabama Heating & Air Conditioning Contractors Board at https://hacr.alabama.gov/.
Plumbing contractors are required to hold an active Master Plumbers license from the Alabama Plumbers & Gas Fitters Examining Board at http://www.pgfb.alabama.gov/.
Gas contractors are required to hold an active Master Gas Fitters license from the Alabama Plumbers & Gas Fitters Examining Board at http://www.pgfb.alabama.gov/. Note: The County Building Department currently does not issue permits for gas work.
Fire protection sprinkler contractors are required to hold an active Fire Protection Layout Technician – Level III credential from the National Institute for Certification in Engineering Technology (NICET) at https://www.nicet.org/ and hold an active Sprinkler System Permit from the State of Alabama Fire Marshal’s Office at https://www.firemarshal.alabama.gov/.
Any subcontractor performing commercial or multi-family work (non-residential) with a minimum job valuation (contracts including labor and materials) of $100,000 ($5,000 for swimming pools) under contract to a licensed prime contractor must also be licensed by the Alabama Licensing Board for General Contractors at https://genconbd.alabama.gov/.

🟦 MANUFACTURED HOME INSTALLATION CONTRACTORS:

Manufactured/Mobile Home Installers are required to hold an active Installers license from the Alabama Manufactured Housing Commission at https://amhc.alabama.gov/.

🟦 MANUFACTURED/MODULAR HOME OR BUILDING INSTALLATION CONTRACTORS:

Manufactured/Modular Homes and Buildings Installers are required to hold an active Installers license that begins with the number "8" from the Alabama Manufactured Housing Commission at https://amhc.alabama.gov/.

🟦 FOR NON-RESIDENTIAL/COMMERCIAL/MULTI-FAMILY CONSTRUCTION:

Contractors who work with commercial or multi-family (non-residential) structures with a job valuation (cost of labor & materials) of $100,000.00 or more or who construct any swimming pool with a job valuation of $5,000.00 or more are required to have a general contractors license. Subcontractors performing minimum contracts including labor and materials of $100,000 ($5,000 swimming pools) or more under contract to a licensed prime contractor must also be licensed by the General Contractors board. You may search for licensed General Contractors on the Alabama Licensing Board for General Contractors website at https://genconbd.alabama.gov/.

🟦 FOR RESIDENTIAL CONSTRUCTION and ROOFING:

The "Consumers" section of the Alabama Home Builders Licensure Board at https://hblb.alabama.gov/consumers/ has great tips to review prior to hiring a contractor.
Contractors who will repair or replace a residential roof with a job valuation (cost of labor & materials) over $2,500.00 are required to hold a home builders roofers license and a $10,000.00 bond; OR they can hold an unlimited home builders license.
Contractors who work with residential structures with a job valuation (cost of labor & materials) over $10,000.00 are required to have a home builders unlimited or limited license. If the work involves more than one trade and/or affects structural integrity, the builder is required to have an unlimited license.

Contractors who construct any swimming pool with a job valuation of $5,000.00 or more are required to be licensed by the Alabama Licensing Board for General Contractors at https://genconbd.alabama.gov/.

Section #3: Property Owner Acting as Own Contractor

Note: Permits are required even if a property owner acts as their own contractor, performs the construction/work, and does not hire or compensate a contractor.

🟦 FOR TRADE PERMITS (Electrical, Mechanical/HVAC, Plumbing, Gas):

Property owners can perform their own mechanical, electrical, and plumbing work. However, you should obtain separate Trade Permits for each of those trades prior to starting the work.
Although the Baldwin County Building Department does not currently require or issue permits for gas fitting, you must follow the guidelines of the State of Alabama Plumbers & Gas Fitters Examining Board. Property owners should not perform their own gas fitting work. Gas fitting work should be performed only by contractors who hold an active Master Gas Fitter license from the Alabama Plumbers & Gas Fitters Examining Board at http://www.pgfb.alabama.gov/.

🟦 FOR RESIDENTIAL CONSTRUCTION:

The State of Alabama Home Builders Licensure Law ( https://hblb.alabama.gov/law/) requires residential construction to be performed by a licensed residential home builder. The property owner can request an exemption to that law. This exemption allows the owner of the property to act as his/her own builder even though he/she does not have a license.
You may build or improve your own residence, but it must be for your own use and occupancy. It may not be built or improved for the purposes of selling. If you place the residence for sale within one year after the construction is complete, the law will presume that you built it for sale, which is a violation of this exemption.
You may not hire or compensate anyone to supervise the building or improvement of the residence. It is property owner's responsibility to make sure that subcontractors employed by you have the proper licenses required by state law and a State of Alabama business license issued through any county in the state. Your construction must comply with all applicable laws, ordinances, building codes, and zoning regulations.
By claiming exempt status, the property owner waives his/her rights for protection under the provisions of the Home Builders Licensure law. In the event of litigation involving activities resulting from the granting of a permit, the property owner may not make demand of any money from the Homeowner's Recovery Fund, established by the Home Builders Licensure law.

To qualify for this exemption, the property owner must review, complete, and return this form to the Building Department before the permit is issued.

🟦 FOR NON-RESIDENTIAL / COMMERCIAL CONSTRUCTION:

Property owners are exempt from the licensing requirements of the State of Alabama General Licensure Law ( https://genconbd.alabama.gov/Law.aspx) pursuant to Section 34-8-1 when acting as their own contractor and providing all materials and supervision for the construction. Any of the work contracted out must comply with the definition in this chapter for general contractor. Section 34-8-7 (a)(3). The property owner should be fully aware of the State Laws and remain in compliance with the requirements for exemption to permit as an owner. Section 34-8-9 (amended 2006).
The property owner should understand that by claiming exempt status, they waive their rights for protection under the provisions of the General Contractors Licensure law and that in the event of litigation involving activities resulting from the granting of this permit.
The property owner should also understand that permits for subcontractor work in electrical, plumbing, gas, heating, air conditioning, and refrigeration must hold valid licenses from the appropriate state board of contractors.
Any permit obtained by an owner acting as his/her own contractor may be subject to a review and approval by the Alabama General Contractors Licensure Board.

Section #4: Location Based - for UNZONED Property within or near a Special Flood Hazard Area and/or a Potential Wetland Area

NOTE: This section does not apply to most permit applications for trades such as Re-Roofing, Mechanical/HVAC, Electrical, Plumbing, Fire Protection Sprinkler, or replacing doors/windows.

🟦 FLOOD LAND DISTURBANCE:

Refer to the Land Disturbance Ordinance for Flood Prone Areas or Territories
A land disturbance is the disturbance of soil associated with grubbing, grading, excavating, filling of land, or other similar activities which may result in soil erosion:
- Filling - Bringing any type of fill material (including sand, gravel, etc).
- Grading - Adding, removing, or rearranging of earthen materials to ensure a level base or specific slope.
- Excavation - Any mechanical removal of rock, sand, gravel, or other unconsolidated materials from a location. This also includes grubbing which is the shallow digging of surface soil generally to clear away roots, stumps, and similar subsurface vegetation.
- Dredging - Removal of material from the bed of a waterbody, waterway, or wetland.
Flood Land Disturbance approval is required for any land disturbances occurring in an unzoned area if one or more of the following apply:
- The land disturbance is within the potential wetlands layer.
- The land disturbance is within a flood prone area.
- The land disturbance is within 30 feet of the potential wetlands layer and more than 25 square feet of land disturbance.
- The land disturbance is more than 30 feet but less than 50 feet from potential wetlands layer and more than 500 square feet of land disturbance.
As of October 1, 2024, the Flood Land Disturbance review has been combined with the Building Permit application. You will not need to submit a separate application for the Flood Land Disturbance. However, the Baldwin County Planning and Zoning Department will review your Building Permit application information to verify compliance with the Land Disturbance Ordinance for Flood Prone Areas or Territories.

Section #5: Location Based - for ZONED Property

NOTE: This section does not apply to most permit applications for trades such as Mechanical/HVAC, Electrical, Plumbing, Fire Protection Sprinkler, Replacing Windows/Doors, Re-Roofing. This section does apply to replacing windows/doors and re-roofing in Historic Districts. This section does apply to Re-Roofing within the municipal limits of Magnolia Springs.

🟦 ZONING - ADMINISTRATIVE SITE PLAN APPROVAL (also know as a LAND USE CERTIFICATE)

Zoning - Administrative Site Plan Approvals or Land Use Certificates are required for any property located in a ZONED AREA of the County or within the municipal limits of Elberta, Magnolia Springs, or Perdido Beach for the construction, reconstruction, repair, demolition, conversion / change of use, structural alteration, relocation, removal, or enlargement of any building or structure to verify that the structure will comply with the applicable Zoning Ordinance.

To determine if a property is zoned and if a Zoning - Administrative Site Plan Approval / Land Use Certificate is required, you may contact the applicable Planning & Zoning Department:

For the municipal limits of Elberta, Magnolia Springs, or Perdido Beach, you should apply for the Land Use Certificate and receive approval from the town's Planning & Zoning Department BEFORE submitting a building permit application.

For zoned areas within the unincorporated areas of Baldwin County, when related to a Commercial or Multi-Family Project, the Zoning - Commercial Site Plan Approval must be applied for and approved by the Baldwin County Planning and Zoning Department BEFORE a building permit can be approved and issued. For zoned areas within the unincorporated areas of Baldwin County, when related to a Residential Project, Cell Tower, or Signs/Billboards, as of October 1, 2024, the Zoning - Administrative Site Plan Approval review has been combined with the Building Permit application. You will not need to submit a separate application for the Zoning Site Plan Approval. However, the Baldwin County Planning and Zoning Department will review your Building Permit application information to verify compliance with the Baldwin County Zoning Ordinance.

For a Residential Project Zoning - Administrative Site Plan Approval review, the Baldwin County Planning & Zoning Department may require the following documents in addition to the Baldwin County Building Department's regular requirements::

🟦 Construction Best Management Practices Plan (CBMPP) - A simplified CBMPP explains the steps that you will take (such as silt fence, hay bales, trash containment locations, gravel construction access, restroom facilities, a final stabilization method, etc.) to minimize the amount of pollution and soil erosion that could leave the site and impact surrounding areas. Note: The applicant may complete the attached CBMPP form if an ADEM NPDES General Permit is not required as stated above. If an ADEM NPDES General Permit is required (land disturbance will be greater than one acre), then a Civil Engineer or a Qualified Credentialed Professional (QCP) must prepare a CBMPP for the project.

🟦 Basic Floor Plan and Elevations - must include the layout of each floor with rooms labeled; must also include front, rear, and side elevation drawings (this can be included within the construction plans)
🟦 Land Disturbing Activities - Be prepared to describe any proposed land disturbing activities such as clearing, grading, removing stumps, excavation, or filling (use of sand, soil, gravel, etc.) Will the existing grade be raised more than two feet anywhere on the property? Will more than one acre of land be disturbed?
🟦 ADEM NPDES General Permit – required if land disturbance will be greater than one acre; contact ADEM at 334-271-7714 or permits@adem.alabama.gov for more info.
🟦 Parking Plan – required for properties on the FORT MORGAN PENINSULA (PLANNING DISTRICT 25) - must be provided on the Site Plan and labeled 9’ x 19’; required parking spaces must be unobstructed; the number of required spaces is based on the number of bedrooms:
- 1 to 4 bedrooms = 2 spaces
- 5 to 6 bedrooms = 3 spaces
- 7 or more bedrooms = 4 spaces plus 1 additional space for every bedroom over 8

Section #6: Location Based - for Structure in a Special Flood Hazard Area (FLOOD ZONE) or in a FLOODWAY

NOTE: This section does not apply to permit applications for trades such as Re-Roofing, Mechanical, Electrical, Plumbing, and Fire Protection Sprinklers.

Structures located in a Flood Zone or in a Floodway must meet the Baldwin County Floodplain Development Ordinance and Flood Zone Requirements. Refer to the Flood Zone Info section of this website for additional information.

CHECKLIST FOR STRUCTURE LOCATED IN A FLOOD ZONE

🟦 Temporary Benchmark (TBM) or Elevation Certificate (EC) - TBM must be provided on a survey or statement signed and stamped by an Alabama registered engineer, surveyor, or architect; EC must be provided on an official FEMA Elevation Form that is signed and stamped by an Alabama registered engineer, surveyor, or architect; refer to www.fema.gov/glossary/elevation-certificate

🟦 Coastal A Zone or V Zone Certificate – required if structure will be located in a Coastal A Zone or in a V Zone; must be signed and stamped by an Alabama registered engineer, surveyor, or architect; download the form here

🟦 Permit to Develop in a Special Flood Hazard Area – after you apply for a Building Permit and before the permit is issued, the contractor or property owner will be required to review and sign a Flood Permit form that will be provided to you by the Building Department

🟦 Under Construction Elevation Certificate - this document MAY be requested by the Building Inspector after the project has started depending on project conditions; must be signed and stamped by an Alabama registered engineer, surveyor, or architect

🟦 Finished Construction Elevation Certificate - must be submitted after permit is issued, near the end of the project before scheduling the final building inspection; must be signed and stamped by an Alabama registered engineer, surveyor, or architect

Section numbers 4 - 8 may also apply to this type of project.

🟦 Permit Application – Submit a Building Permit (Residential) or Building Permit (Commercial/Multi-Family) application in the CitizenServe Portal with the sub-type: Accessory Structure (Barn/Shed/Storage Building/Gazebo/etc).

Use the Residential option if there is a primary residential structure on the property. For vacant lots with storage use, select "Misc. Storage Structure (No Dwelling on Property)."
Use the Commercial/Multi-Family option if the primary structure is commercial or multi-family.

🟦 Address Request, Verification, or Correction Letter – Required if this will be the first structure on the property. Submit via the Baldwin County 911 Addressing Form or visit www.baldwin911.org.

🟦 Proof of Ownership – Required if the deed is not recorded with the Probate Office or not listed with the Revenue Commission Office.

🟦 Construction Plans – Must be to scale and submitted in PDF format. Refer to the adopted building codes for requirements.

Residential: Engineered plans required, signed and stamped by an Alabama licensed architect or engineer.
Commercial/Multi-Family: Plans must be signed and stamped by both an Alabama licensed architect and engineer.
Exceptions: Detailed non-engineered plans may be accepted for smaller accessory structures, depending on size and use.

🟦 Site Plan – Must be to scale, show all structures with dimensions, and include distances from property lines and other structures.

🟦 Driveway Permit – Required if this is the first structure on the property. Confirmation must be provided from the appropriate authority:

For state highways, contact ALDOT at 251-937-2086.
For other roads, submit a Residential Driveway Permit or a Commercial Turnout Permit. Contact Baldwin County Highway Dept.: North Baldwin 251-937-0371, Central Baldwin 251-972-6897, South Baldwin 251-990-4635.

🟦 Sewer or Health Department Release – Required only if plumbing will be added.

Contact the property's sewer utility for sewer release.
For septic, contact the Baldwin County Health Department at 251-947-3618 or 251-937-6935.

🟦 Type of Construction – Will the structure be built on-site or delivered pre-manufactured?

🟦 Use of Building and/or Storage Area – What is the purpose of the structure and what will be stored inside?

🟦 Additional Documentation – Any documents deemed necessary by the Building Department may also be required.

Marine Accessory (ex. Boathouse, Pier, Dock, etc.)

This type of application is required for any new construction of, addition to, or alteration/repair of a MARINE ACCESSORY (ex. boathouse, pier, dock, etc.) that is located within a Special Flood Hazard Area.

If the marine accessory is not located within a Special Flood Hazard Area, the Baldwin County Building Department does not require a permit for the work; and this application is not required. However, other agencies may still require approval before the work begins. We strongly suggest you contact the US Army Corps of Engineers Mobile District at 251-690-2658 AND the State Lands Division of the Alabama Department of Conservation and Natural Resources at 251-621-1238 for more information.

CHECKLIST OF REQUIRED INFO & DOCUMENTS

NOTE: Section #1 above applies to all permits. Section numbers 2, 4, 5, 6, 7, & 8 above may also apply to this type of project.

🟦 Flood Permit Application – In the Citizenserve Portal, submit a Flood Permit application with the sub-type of Marine Accessory (Boathouse/Pier/Dock/Boatlift/Bulkhead/Seawall).
🟦 Address Request, Verification, or Correction Letter – required if there is not a residential dwelling already on the same property with a verified Baldwin County 911 address; submit an Address Request and Verification on the Baldwin County 911 website at www.baldwin911.org.
🟦 Proof of Ownership – a copy of a certified deed will be required only if the deed has not been recorded with the Probate Office or the current owner is not listed on the Revenue Commission Office property tax records as of yet.
🟦 U.S. Army Corps of Engineers Permit – Visit the US Army Corps of Engineers Mobile District website or call 251-690-2658 for info.
🟦 Alabama State Lands Division Permit (Notice of Intent to Impact State Owned Submerged Land) – Visit the State Lands Division website or call 251-621-1238 for info.
🟦 Electrical Permit Application – If the work will include any electrical wiring or service to be altered or added, a separate Electrical Permit will be required. In the Citizenserve Portal, submit a Trade Permit application with sub-type of Electrical Permit.
🟦 Additional Documentation – Any additional documentation deemed necessary by the Building Department.

Dune Walkovers

A dune walkover is a raised walkway constructed for the purpose of protecting the beach and dune system between mean high tide and the construction control (CCL) line from damage that may result from anticipated pedestrian traffic to the beach, and which is contained within the area of the private lot(s) and complies with the design and construction requirements established by the Alabama Department of Environmental Management (ADEM) and the United States Fish and Wildlife Service (USFWS).

NOTE: Section numbers 1, 2, 3, 5, 6, 7, & 8 above may apply to this type permit application.

🟦 Permit Application – In the CitizenServe Portal under the Building Department section, click on APPLY FOR A PERMIT. Next, choose the permit type of BUILDING PERMIT (RESIDENTIAL) or BUILDING PERMIT (COMMERCIAL/MULTI-FAMILY). Choose the sub-type of DUNE WALKOVER. Please note that Baldwin County staff will internally create a "Zoning - Administrative Site Plan Approval" application and a "Coastal Area Program Permit" application using the information the applicant provides on the Building Permit application. This allows the applicant to submit only one application that will be reviewed by all applicable County departments (Planning and Zoning Department, Coastal Area Program, and/or Building Department).

🟦 Administrative Site Plan Approval from the Baldwin County Planning & Zoning (P&Z) Department – The applicant is not required to submit a separate P&Z application. However, the application information will be reviewed by the P&Z Department and must be approved prior to the issuance of the Coastal Area Program Permit. 🟦 United States Fish and Wildlife Services (USFWS) Incidental Take Permit (ITP) – Visit the USFWS website at https://epermits.fws.gov/ or call 251-441-5868 or 251-441-5181 for more details on how to obtain this permit.

🟦 Proof of Ownership – A copy of a certified deed will be required if the deed has not been recorded with the Probate Office or the current owner is not listed on the Revenue Commission Office property tax records as of yet.

🟦 Recent Survey – A recent survey prepared and stamped by a Professional Land Surveyor registered in the State of Alabama; survey should show the property lines and lot dimensions along with the location, size, and alignment of all existing and proposed structures. It should include the height, width, and length of the walkover, dune height, vegetation line, and construction control line (CCL).

🟦 Construction Plans – Must be drawn to scale and provided in a digital PDF format.

🟦 Any additional documentation deemed necessary by the Coastal Area Program division of the Building Department.

Based on the Baldwin County Zoning Ordinance, a dune walkover shall be constructed to the following standards:

There shall be no more than one (1) dune walkover per parcel.
The elevation of dune walkovers shall begin within 36" of finished grade at the seaward side of the lot and must be accessible from ground level at finished grade. Dune walkovers are not allowed to attach directly to the structure of the home or elevated deck.
The maximum width of the dune walkover shall adhere to the permit requirements and design and construction standards of ADEM and USFWS. Maximum widths shall be applicable to all sections of the dune walkover, including but not limited to steps, lookout areas, ramps, landings, and decks.
The elevation from the bottom of floor joists of the dune walkover shall adhere to ADEM and USFWS design and construction standards and permit requirements.
No vertical or horizontal members shall be allowed above thirty-eight (38) inches from the walking surface, i.e. handrails, pergolas, etc.
The dune walkover shall terminate ten (10) feet seaward of the vegetative line of the dune when the private lot extends seaward beyond the vegetative line. For private lots that do not extend seaward beyond the vegetative line, the applicant shall coordinate with USFWS and the Baldwin County Planning Director, or designee, to determine the appropriate termination point of the dune walkover within the boundaries of the private lot.
The location and length of the dune walkover is to be coordinated through and approved by the delegated authority of ADEM and USFWS.
No lighting shall be utilized on a dune walkover.
No dune walkover construction shall occur during the sea turtle nesting season from May 1st through November 1st.

Manufactured Homes/Mobile Homes/Trailers
