NOTICE OF PUBLIC HEARING

 

CASE NO: VAC-22-2

 

NOTICE IS HEREBY GIVEN in accordance with Section 23-4-2 and 23-4-20 of the Code of Alabama (1975), as amended, that the Baldwin County Commission will hold a Public Hearing on Tuesday, July 19th, 2022 beginning at 8:30 a.m. at the Baldwin County Fairhope Satellite Courthouse County Commission Meeting Chambers-2nd Floor, 1100 Fairhope Avenue, Fairhope, Alabama, to consider vacating the unpaved portion of Etta Smith Road. More particularly described as follows:

 

LEGAL DESCRIPTION OF THE UNPAVED PORTION ETTA SMITH ROAD SAID RIGHT OF WAY PROPOSED TO BE VACATED

 

Commencing at the northern most corner of Lot 14 of Robinson Branch Subdivision, Phase Three, Slide 2279-A;  thence run S 36°45’21” West 79.72 feet to a point; thence continue S 36°45’21” West  63.09 feet to a point; thence run S 56°18’34” East 36.14 feet to a point on the south line of Slide 2279-A and being the Point of Beginning of the prescriptive right of way herein described; thence run S 60°23’27”East 78.54 feet to a point; thence run S 79°1’33” East 227.91 feet to a point; thence run N 70°29’1”East  64.62 feet to a point; thence run N 53°46’37”East 209.18 feet to a point; thence run N 71°19’24” East 364.32 feet to a point; thence run S 78°41’25” East 29.65 feet to the point of ending at the corner clip along the west right of way line of County Road 9. Said described line being the approximate centerline of the prescriptive right of way to be vacated and located in Section 32, Township 6 South, Range 3 East, Baldwin County, Alabama.

 

LAYMEN’S DESCRIPTION OF THE UNPAVED PORTION OF ETTA SMITH ROAD SAID RIGHT OF WAY PROPOSED TO BE VACATED 

 

All that prescriptive portion of Etta Smith Road right of way from Robinson Branch Subdivision, Phase Three as recorded in Slide 2279-A, running southeasterly thence northeasterly to point of ending at the west right of way line of County Road 9 and located in Section 32, Township 6 South, Range 3 East, Baldwin County, Alabama.
